Competent courts in case of dispute

1Purpose

These terms of service govern access to and use of the overlyne.com website, published by Overlyne, a limited liability company under Tunisian law, registered with the Commercial Registry of Monastir. By accessing the site, you accept these conditions without reservation. If you do not accept these conditions, please do not use the site.

The site is freely accessible from anywhere to any user with internet access. Overlyne uses best efforts to ensure 99.9% availability. However, Overlyne reserves the right to suspend, modify or interrupt access without notice for maintenance, updates or force majeure as defined in Article 283 of the Tunisian Code of Obligations and Contracts.

4Intellectual Property

All elements of the site (texts, images, logos, graphics, icons, sounds, software, design, site architecture) are protected by Tunisian and international intellectual property laws, notably Law No. 2009-33 of June 23, 2009 on copyright and neighboring rights. Any unauthorized reproduction, representation, modification or exploitation of all or part of the site is strictly prohibited and constitutes counterfeiting sanctioned by Articles 47 and following of said law.

Specific conditions for each service are defined in separate commercial contracts.

6Limitation of Liability

Overlyne strives to provide accurate and up-to-date information. However, site information is provided for informational purposes and does not constitute a contractual commitment. Overlyne cannot be held liable for direct or indirect damages resulting from site use, including data loss, revenue loss or profit loss, in accordance with the Tunisian Code of Obligations and Contracts.

7Personal Data

Processing of personal data collected through the site is carried out in accordance with Organic Law No. 2004-63 of July 27, 2004 on the protection of personal data. For more information, see our Privacy Policy.

8Applicable Law and Jurisdiction

These terms are governed by Tunisian law. In case of dispute regarding interpretation or execution of these terms, parties commit to seeking an amicable solution prior to any legal action, in accordance with mediation practices. Failing amicable resolution within 30 days, the competent courts of Monastir (Tunisia) will have sole jurisdiction.

9Modification

Overlyne reserves the right to modify these terms at any time. Changes take effect upon publication on the site. Users are advised to regularly check this page. Use of the site after modification constitutes acceptance of the new conditions.
